PDM MPs condemn the onset of activities 4 abusive dismissal of Prosecutor General E.Harunjen: By these actions the autonomy of Prosecution is demolished & justice becomes subordinate to PSRM-ACUM
Today, the Parliament convened in a plenary meeting to initiate the procedure to dismiss Prosecutor General, Eduard Harunjen. The arguments of PSRM-ACUM coalition say that there was a "procedural breach" when the Prosecutor General was appointed, as he allegedly was a member of the Supreme Council of Prosecutors (SCP). Sergiu Sirbu, member of PDM's parliamentary faction, stated that there is no legal ground for this argument, and in December 2016 Constitutional Court ruled on this matter and stated expressly that Eduard Harunjen was never a member of SCP. Moreover, only the SCP can initiate the procedure to dismiss Prosecutor General, The Parliament cannot be involved in this process after the reform of Prosecution.
Igor Vremea, member of the Parliament, urged the parliamentarians not to treat the institution of Prosecution through an individual who is uncomfortable for them. Law must prevail, not personal attitudes. In this context, Igor Vremea specified that GRECO, Council of Europe's anti-corruption body, welcomed the way Prosecutor General was selected in Moldova, according to the new Prosecution Law.
"The recent attacks against Prosecution and courts undermine their autonomy and independence. PSRM-ACUM parliamentary majority are wiping their feet on the Constitution of the Republic of Moldova - the Supreme Law of our country - to subdue Prosecutor General's Office to themselves", said Vladimir Cebotari, member of PDM's parliamentary faction.
Despite the arguments presented, Kozak coalition voted a decision that establishes that Eduard Harunjen did not fully comply with conditions for appointment as prosecutor general. Thusly, they have abusively initiated his dismissal.
According to PDM's parliamentary faction, after today's decision of the Parliament, independence of Prosecution is no longer there, as prosecutor general will not be able to act independently, being subject to political influence and dependant on the Parliament and president of the country.
